Hi Shamim, many thanks for your question.
The answer depends very much on which particular form of contract is in place between the Employer and the Contractor and also, whether it has been subject to any amendments. The JCT Design & Build Std form 2016 for example covers this point at clause 4.24 where it sets out that the Contractor shall submit his Final Statement to the Employer within 3 months of Practical Completion of the Works and what the Employer may then do if the Contractor fails to do so.
Other standard, amended or bespoke forms of contract may have different requirements.
