Good question Mike. I was recently asked to provide Expert Witness testimony on a dispute in Ireland where the fit out contract was removed from my client's account and handed to a competitor. The question of loss of profit was heard at conciliation and my client was awarded around €500K. I used the company's account for a 4 year period around the date of the omission along with the tendering records of the company showing the missed opportunities/success rates in winning tenders. I was also given examples of other direct losses incurred in support of the claim. The Law Review recently published an interesting article on these types of claims.
