Absolutely. Even a complex EOT matter can be resolved through Adjudication. What it does mean is that both sides need to be on top of their contract administration so that if a 'surprise 'adjudication comes their way, that they have the relevant facts available to form part of the defence. An adjudicator needs clear information from both parties to be able to consider the position. Otherwise the decision is likely to be favourable to one party due to a lack of clarity rather than what is factually correct.
